ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES
Britain's Dream Teachers (the "Contest") is a skill contest where participants must submit a video to the Dream Teachers Brand Channel on YouTube at www.youtube.com/dreamteachers ("Website") that answers one of the Dream Teachers' questions as specified on the Website. Please refer to the Website for a general description of the Contest and FAQ’s regarding the content of your Video. The videos will be evaluated by a panel of judges as further detailed in paragraph 7 who will choose the winning entry in accordance with these Rules, as further detailed below.
Fresh One Productions Limited ("Fresh"), producers of the Channel 4 television programme entitled "Dream School" are running this Contest on behalf of Google Ireland Limited ("Google"), and Google is the provider of the Prizes as further detailed below. Channel 4 is assisting Fresh and the Judges with the adjudication of Video entries at the Judging Day (described in paragraph 7).
1. BINDING AGREEMENT: You agree that submission of an entry in the Contest constitutes agreement to these Rules so please read the Rules carefully. You may not submit an entry to the Contest and are not eligible to receive the Prizes described in these Rules unless you have ticked the relevant box on the Website to confirm that you have read and understood and agree to comply with these Rules. These Rules form a binding legal agreement between you and Fresh and Channel 4 with respect to the Contest and between you and Google with respect to the provision of the Prizes. Please note the Rules may be subject to change and you agree to be bound by any changes. Any changes will be posted on the Website.
2. ELIGIBILITY: To be eligible to enter the Contest, you must be: (1) 18 years of age or above at the time of entry; (2) be a legal resident of, and physically located in, England, Wales, Scotland Northern Ireland ;(3) a qualified teacher or teacher in training teaching students that are entering for their GCSE or Standard Grade exams in England, Wales or Scotland Northern Ireland; (4) have permission to enter the Contest from the school that employs you (note that supply teachers and teachers-in- training must notify the school they are working at when they enter their submission, which school will be the eligible institution for any school award component of the Prize); (5) not a person or entity under U.S., United Kingdom or European Union export controls or sanctions; and (6) have access to the Internet as of 18 February 2011. Employees, interns, contractors, and official office-holders of Google, Fresh, Channel 4 and their parent companies, subsidiaries, affiliates, and their respective directors, officers, employees and agents are ineligible to participate in this Contest.
If you are entering as part of a company or on behalf of your employer, these rules are binding on you, individually, and/or your employer. If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consented thereto, including your potential receipt of a Prize. You further warrant that your actions do not violate your employer's or company’s policies and procedures. Additionally, Fresh and Google reserve the right to withhold the awarding of a prize to a school which is not eligible to receive a prize pursuant to point 5 above.
Fresh and Google reserve the right to verify the eligibility of entrants and to check their identity, and to withhold delivery of any Prize pending receipt of proof of identity and eligibility, and to disqualify any entrant who is found not to meet the eligibility criteria.
3. CONTEST PERIOD: The Contest begins at 09:00:00 A.M. Greenwich Mean Time ("GMT") Zone in the United Kingdom on 21 February 2011 and ends at 11:59:59 P.M. GMT on 5 April 2011 ("Contest Period").
5. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. To enter the Contest, visit the Website during the Contest Period and follow the instructions for submitting a video ("Video") . (“Video”). There is no limit on how long each Video must be, however, please note that each Video will be judged on the first five minutes only. The Video must also meet the “Video Requirements” described below. You will be required to identify the subject matter of your video at the time of entry. All entries must be received by 11:59:59 p.m. (GMT) on 5 April 2011. Entries are void if they are in whole or part inaudible, incomplete, damaged, altered, counterfeit, obtained through fraud, or late. All entries will be deemed made by the authorised account holder of the email address submitted at the time of entry, and the potential winner may be required to show proof of being the authorized account holder for that email address. The "authorized account holder" is the natural person assigned to an email address by an Internet service provider, online service provider, or other organization responsible for assigning email address for the domain.
6. VIDEO REQUIREMENTS. The Video must meet the following criteria:
Fresh, in conjunction with Channel 4 will be evaluating each Video before it is posted on the Website to ensure that it complies with the Video Requirements. If however you view a Video and believe it violates any of the Video Requirements, you can contact Fresh with your concerns at dreamteachers@freshone.tv. The email must identify the Video at issue and explain the potential issue. Fresh reserves the right, in its sole discretion, to disqualify any entrant who submits a Video that does not meet the Video Requirements.
Please note that if your Video is not compliant with the Video Requirements and/or you or your school are not eligible pursuant to paragraph 2, your Video will not be uploaded, and due to the number of entries being reviewed, you will not be contacted if this is the case.
7. JUDGING: There are separate judging panels for each subject category. Entries will be judged by expert education panels made up of at least 3 judges for each subject category and the judges will be previous UK Teaching Award winners and judges ("Judges").
After the Contest closing date on April 5th 2011, each video entry will be evaluated by the Judges for the relevant subject category based on the following criteria:
Shortlisting
The 3 or more Judges in each subject category will each individually identify a shortlist of 3 Video entries. The Judges’ selections will then be combined to make a final shortlist of each of the entries
(so if there are 3 Judges for example, there will be 9 entries per subject category unless the judges
shortlist the same video(s)). The Judges reserve the right to select less than 3 videos in a subject
category if less than 3 highly scored videos are submitted in a category.
These shortlisted entries will then be reviewed by all the Judges on the panel for that subject category
who will then identify their 1st, 2nd and 3rd preferences – this will happen at the Judging Day (see
below).
Judging Day
On or about April 11th 2011 the Judges on each subject category panel will meet to discuss and
debate their preferences at a judging day – hosted and adjudicated by Channel 4.
At the end of this meeting the Judges must agree a winner for each subject category based on the
above judging criteria.
Winner Notification
On or about April 13th 2011 the winners in each category will be selected and notified by telephone
and/or email, at Fresh’s discretion. If a potential winner does not respond to the notification attempt
within 2 days from the first notification attempt, then such potential winner will be disqualified and
an alternate potential winner will be selected from the judges shortlisted entries based on the judging
criteria described herein.
With respect to notification by telephone, such notification will be deemed given when the potential winner engages in a live conversation with Fresh or when a message is left on the winner’s voicemail service or answering machine by Fresh, whichever occurs first. Except where prohibited by law, each potential winner may be required to sign and return declarations of eligibility or other paperwork that may be required by Google in advance of awarding the Prize. If required, potential winners must return all such required documents within 7 days following attempted notification or such potential winner will be deemed to have forfeited the Prize and another winner will be selected based on the judging criteria described herein.
In the event that no Videos are received, no Prizes will be awarded. Determinations of Judges are final and binding and may not be appealed or challenged.
8. PRIZES: The Prizes to be awarded are as follows:
The odds of winning any prize depends on the number of eligible entries received and the skill of the entrants. The prizes will be awarded within approximately 4 weeks of receipt by Google of final prize acceptance documents. No transfer, substitution or cash equivalent for Prizes is permitted by winners. Google reserves the right to substitute a Prize, in whole or in part, of equal or greater monetary value if a Prize cannot be awarded, in whole or in part, as described for any reason. Google has not made and is not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the Prize, regarding the use, value or enjoyment of the Prize.
10. TAXES: PAYMENTS TO POTENTIAL WINNERS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO GOOGLE ANY AND ALL DOCUMENTATION REQUESTED BY GOOGLE TO PERMIT IT TO COMPLY WITH ALL APPLICABLE FEDERAL, STATE, PROVINCIAL, LOCAL AND FOREIGN TAX REPORTING AND WITHHOLDING REQUIREMENTS. ALL PRIZES WILL BE NET OF ANY TAXES THE AWARDING ENTITY IS REQUIRED BY LAW TO WITHHOLD. ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. In order to receive a Prize, winners must submit any tax documentation requested by Google or otherwise required by applicable law, to Google or the relevant tax authority, all as determined by applicable law, including, where relevant, the law of the potential winner’s country of residence. The winners are responsible for ensuring that they comply with all the applicable tax laws and filing requirements. If a winner fails to provide such documentation or comply with such laws, the Prize may be forfeited and Google may, in its sole discretion, select an alternative winner.
11. GENERAL CONDITIONS: All local laws and regulations apply. Fresh reserves the right to disqualify any entrant from the Contest if, in Fresh’s sole discretion, it reasonably believes that the entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants, viewers, Fresh, Google, Channel 4 or the Judges.
12. INTELLECTUAL PROPERTY RIGHTS: As noted in the YouTube terms and conditions (http:// www.youtube.com/t/terms) between YouTube LLC and the entrant, the entrant retains ownership of all intellectual and industrial property rights (including moral rights) in and to the Videos submitted. As a condition of entry, entrant grants Fresh, Channel 4 and Google and their subsidiaries, agents and partner companies, a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, create a derivative work from, and publicly display a Video (1) for the purposes of allowing Google and the Judges to evaluate the Video for purposes of the Contest, and (2) in connection with advertising and promotion via communication to the public or other groups, including, but not limited to, the right to make screenshots, animations and video clips available for promotional purposes. All rights, including intellectual property rights, in the look and feel of the Website and all logos, designs and graphics on the Website shall belong to Google (and Fresh in relation to Fresh’ logo, and Channel 4 in relation to Channel 4’s logo).
13. PRIVACY: As part of your entry you will be required to submit certain personal data about yourself, including your name, age and email address and address of the school where you are employed. Such information will be stored by Fresh and passed onto Google in order that Fresh can administer the Contest and so that Google can award the Prizes. Fresh shall keep all personal data you submit securely and will only use such information for the purpose of administering this Contest and awarding the Prizes. Fresh may pass your personal details to Channel 4 for the purpose of Channel 4 adjudicating the Contest and moderating Videos. For Google’s privacy policy, please click on this link www.youtube.com/t/privacy_at_youtube. After the winners have been selected, their names will be submitted on the Website and you agree that your name and details of your school may be submitted on the Website for this purpose. You have the right of access to your personal data and subject to paying an administration fee of £10 you may request a copy of all personal data held by Fresh. Please contact dreamteachers@freshone.tv for any such request. If you would like any personal data on the Website deleted at a later date, please also make this request to dreamteachers@freshone.tv.
14. PUBLICITY. By accepting a Prize, entrant agrees to Fresh, Google, Channel 4 and their agencies’ use of his or her name and/or likeness and Video for advertising and promotional purposes without additional compensation, unless prohibited by law.
15. WARRANTY AND INDEMNITY: Participants warrant that their Videos comply with the Video Requirements, and that they shall comply with all the Rules herein.
To the maximum extent permitted by law, each entrant indemnifies and agrees to keep indemnified Google, Fresh and Channel 4 at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each entrant agrees to defend, indemnify and hold harmless Google, Fresh and Channel 4 from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from (a) any Video or other material uploaded or otherwise provided by the entrant that infringes any copyright, trade mark, trade secret, trade dress, patent or other intellectual property right or other rights of any person or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by the entrant in connection with the Contest; (c) any non-compliance by the entrant with these Rules; (d) claims brought by persons or entities other than the parties to these Rules arising from or related to the entrant’s involvement with the Contest; (e) acceptance, possession, misuse or use of any Prize or participation in any Contest-related activity or participation in this Contest; (f) any malfunction or other problem with the Website caused by a bug in the Video submitted.
16. ELIMINATION: Any false information provided within the context of the Contest by any entrant concerning identity, age, mailing address, telephone number, email address, ownership of right or non-compliance with these Rules or the like may result in the immediate disqualification of the entrant from the Contest.
17. INTERNET: Google is not responsible for any malfunction of the entire Website and Google, Channel 4 and Fresh shall not be responsible for any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed Videos due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Website, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an entrant’s ability to participate.
18. RIGHT TO CANCEL, MODIFY OR DISQUALIFY. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Fresh reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Fresh further reserves the right to disqualify any entrant who tampers with the submission process or any other part of the Contest or Website. Any attempt by an entrant to deliberately damage any web site, including the Website, or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Fresh, Channel 4 and Google reserve the right to seek damages from any such entrant to the fullest extent of the applicable law.
19. NOT AN OFFER OR CONTRACT OF EMPLOYMENT: Under no circumstances shall the submission of a Video into the Contest, the awarding of a Prize, or anything in these Rules be construed as an offer or contract of employment with either Google, or Fresh or Channel 4. You acknowledge that you have submitted your Video voluntarily and not in confidence or in trust. You acknowledge that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between you and Google or Fresh or Channel 4 and that no such relationship is established by your submission of a Video under these Rules.
20. GOVERNING LAW AND JURISDICTION
These Rules are governed by English law and the parties submit to the exclusive jurisdiction of the
English courts in relation to any dispute (contractual or non-contractual) concerning the Contest or
these Rules.
